Arraignment and Why Bail Matters

Understanding the court process helps you see exactly why getting out on bail before your first court date is so important.

1

Arraignment

Your first court appearance, usually within 48 hours of arrest. The charges are formally read and you enter a plea. Defendants out on bail attend voluntarily, those in custody are transported in handcuffs from the jail to the courtroom.

2

Preliminary Hearing (Felonies)

For felony charges, a preliminary hearing determines if there is probable cause to proceed to trial. This happens weeks or months after arraignment. Every day you spend in custody waiting is a day you cannot work, be with family, or build your defense.

3

Trial or Plea

Cases are either resolved through a plea agreement or go to trial. Defendants who were free on bail consistently show better outcomes than those held in pretrial custody, because they had time to work with their attorney and demonstrate stability to the court.

Studies show that defendants held in pretrial custody are significantly more likely to receive a conviction and longer sentences than those who were released on bail while awaiting trial, even when controlling for the charge type. Getting out fast is not just about comfort. It is about the strength of your case.

Meet Your Attorney

Review discovery, discuss strategy, and build your best defense from home, not a jail cell.

Keep Your Job

Missing work weakens your case and your finances. Being out keeps your life intact while the case proceeds.

Stay With Family

Continuity matters to judges. Defendants who maintain family and community ties are viewed more favorably.

Attend Voluntarily

Walking into the courtroom on your own looks far better to a judge than being brought in from custody.

Court FAQ

Where is the Stanislaus County Superior Court?+

The main criminal and family law courthouse is at 800 11th Street, Modesto, CA 95354. Phone: (209) 530-3100. A new 8-story, 27-courtroom courthouse recently completed construction at the block of G and H Streets between 9th and 10th Streets in downtown Modesto. Verify your hearing location by calling the court directly, since the transition to the new facility is underway.

How soon after arrest is the arraignment?+

California law requires arraignment within 48 hours of arrest, excluding weekends and holidays. For arrests on Friday, arraignment may not occur until Monday. Every hour between arrest and arraignment that someone sits in custody is time they could have spent out on bail if the bond had been posted. Call 209-284-3002 immediately after an arrest.

Can bail be reduced at arraignment?+

Yes. At arraignment, a defense attorney can make a motion to reduce bail based on factors including community ties, employment status, prior record, and the nature of the charges. Even while waiting for a bail reduction hearing, you can post bail at the current bail schedule amount and potentially recoup the difference later. Call 209-284-3002 and we explain your options.

What happens if the defendant misses a court date?+

If the defendant fails to appear for a scheduled court date, the court issues a bench warrant for their immediate arrest, the bail bond is forfeited, and the co-signer may become liable for the full bail amount. As the bail bondsman, we work proactively to ensure defendants appear at all scheduled court dates.

What is the new Stanislaus County Courthouse?+

The new Stanislaus County Courthouse is an 8-story, 27-courtroom facility at the city block bounded by G and H Streets and 9th and 10th Streets in downtown Modesto.
